Terms of Service

1. Parties
These Terms of Service (the "Terms") are entered into between:
Harcodeck, a sole proprietorship (SAS under formation), with new SIREN number pending approval by the French administration, with registered office at 19 route de chizé, Celles sur belle 79370, France (hereinafter "the Company", "we"), and any individual or legal entity registering on the platform or subscribing to a subscription or purchase order (hereinafter the "Customer").
Any use of the services implies full acceptance of these Terms.
2. Purpose
These Terms define the conditions under which the Company provides the Customer with access to its mobile game platform, online services, APIs and associated features (the "Services"). Harcodeck offers a mobile game service with optional in-app purchases.
3. Contractual Documents
The contract between the parties consists of, in descending order of priority, the following documents:
- The purchase order, subscription page or any commercial offer accepted by the Customer
- These Terms
- The Data Processing Addendum (DPA)
- The Privacy Policy
- The Acceptable Use Policy (AUP)
- The list of subprocessors
In case of conflict, the higher-ranking document prevails.
4. Definitions
- User: any person authorized by the Customer to access the Services.
- Customer Data: all data transmitted, stored or processed through the Services.
- Account Information: identification data, billing information, support exchanges.
- Sub-processor: third-party provider involved in processing Customer Data.
- Third-party Services: external services integrated or used via the platform.
- Usage Data: technical and statistical data related to use of the Services, excluding Customer content.
5. Subscription – Duration – Renewal
The Services are provided as a free game with optional in-app purchases. Purchases made in the game are subject to the distribution platform's terms (App Store, Google Play).
Unless otherwise stated, any subscription is automatically renewed for the same period, unless cancelled by the Customer before the deadline.
6. Intellectual Property
All elements of the Harcodeck game, including but not limited to graphics, cards, illustrations, texts, music, source code and trademarks, are the exclusive property of the Company and are protected by intellectual property laws.
Any unauthorized reproduction, distribution or use of these elements is strictly prohibited.
7. Use of Service
The Customer agrees to:
- Use the service in accordance with these Terms
- Not attempt to bypass the game's security mechanisms
- Not use unauthorized third-party software (hacks, bots, etc.)
- Respect other players and maintain appropriate behavior
- Not sell or trade their account
8. Purchases and Payments
In-app purchases are processed by distribution platforms (App Store, Google Play). The Company does not directly collect payment information.
All purchases are final and non-refundable, except as required by law or in exceptional cases evaluated by the Company.
9. Liability
The Company strives to ensure service availability and quality, but cannot guarantee uninterrupted access. The Company shall not be held liable for damages resulting from:
- Technical interruptions or maintenance
- Data loss due to external factors
- Inappropriate use of the service by the Customer
- Acts of third parties (hacking, attacks, etc.)
10. Personal Data Protection
The Company is committed to protecting users' personal data in accordance with GDPR and applicable laws. For more information, see our Privacy Policy below.
11. Suspension and Termination
The Company reserves the right to suspend or terminate a user's access to the service in case of:
- Violation of these Terms
- Fraudulent or abusive behavior
- Non-compliance with community rules
- Use of unauthorized software
12. Modification of Terms
The Company reserves the right to modify these Terms at any time. Users will be informed of any substantial changes. Continued use of the service after modification constitutes acceptance of the new terms.
13. Applicable Law and Jurisdiction
These Terms are governed by French law. Any dispute will be submitted to the competent courts of France.
